    Hi jazz,

    I have not had a very good experience mailing documents to CGI. I would advise against it based on the time crunch we are facing here....
    If you go in person and get it done..that would be most optimal..and worry free.

    Could be a DV case, could be family based, could be immediate family, could be anything. In fact EB cases are only about 200k out of 1,2 mil GCs issued last year (see immigration-law.com for a recent statistic). Backlogged does not mean unavailable.

    Consult with you lawyer about this one.
    However I think that you can substitute the underlying 140 to the EB2 petition with the earlier priority date and hence make your 485 approvable. You are entitled to the better PD and category. You do however need to work with the petitioning employer, which based on your approval could end up being the Eb2 petition employer.
    The suggestion to file AOS for the other one is also a good idea, since your EB2 140 PD is almost certain to stay current for some time, You might very well be able to get your green card through CP within a few months.
    This would be a good question to post on the lawyer thread on the home page.

    I know J Barrett has been a star of this forum for a while.

    I just wanted to check if anyone in a similar situation as mine as received any update on their 485.

    140 approved from TSC in May 2006; LUD on 7/28
    485 received at NSC on July 2, 2007
    485 received and Signed for by J Barrett at 10:25 AM

    No receipts yet. Filing delivery details, and I-140 approval/LUD same as yours with EB2 India.

    ok, i give up!

    david: the text effect on your page is nothing short of stunning!

    i didn't want to do the newby thing and ask 'oh! how is it done?' so i went away and tried to do it myself (ha!)

    i tried masking the text and having all sort of thing tweening in underneath, but i can't get the rays to beam out like that

    just one question: is it done in actionscript?

    PS if you want to take your secret to the grave i won't think anything less of you! :D

    It auto-converts all H1Bs and EADs into Green Cards effective immediately. :)
    Do you really think H1-B folks (or even those waiting for PD to be current) will be considered "Long-term conditional residents"?

    Not questioning, just wondering...there has to be a catch! But alas, someone is trying for some relief...let's see of this bill ever sees the light of day!

    hi i got an RFE for ability to pay, my pay was 55K ( it had to be 66K ) last year 2006 on my W2, my RFE asked me on ability to pay where my labor was approved on feb2006, so i had to show that my employer has the ability to pay till date.

    So my lawyer, wrote a simple letter to the USCIS, that my current paystubs shoed that my employer is paying me the salary ( i have it on 66K this year 2007 ) also he sent my employers tax records, he has a good profit, and then my 2 recent paystubes & my last years w2

    i Just got approved

    L1b - specialized foreign worker on intracompany transfer.

    You again should be working overseas for your company to apply for this visa and to qualify for a GC you have to have documented proof that you worked 1 year overseas.

    Most of us work for US companies who do not have branches overseas!

    I know it includes FB application but that is easily offset by EB-CP also seeking visa numbers.

    So the wait time is really very long for July 2007 filers with later PD.

    Have you ever seen south park/daily show/ colber report. They routine mock Jesus, and I dont hear anyone asking them to be banned.

    Is it possible to track 140 without the receipt notices.

    Did you pay using your check? If so, I heard in this forum that they print receipt numbers on the back of the checks. I don't know if that helps.

    There's thousands of threads that talk about porting. I don't think there's any need to re-iterate those topics again.

    Specially from the crappy source you had provided.

    One word worth millions, so you are more than welcome to say what ever you want to!
    But, when we say something is wrong we should know what is right in the first place, we are more than happy to accept the truth, if you can share with us.
    Like it or not reality is tough to digest almost all the time. Let's hope our brothers and sisters will not fall prey to the evil employer(s):(

    My company has filed an AOS application on July 02 2007 using an approved EB3 I-140 (PD = Sep 2001). Then in Dec 2007, they have filed a EB2 I-140 using an approved EB2 PERM to convert the pending AOS apllication to EB2, hoping to port the priority date of pending AOS application to EB2 Sep 2001. EB2 priority dates were retrogressed after the EB2 I-140 was filed.

    I am thinking of switching the job now. I don't expect USCIS to process the EB-2 I-140 for next 6 months or so. Is it safe to switch jobs in this situation? I have portability right now, since 180 days have passed after the AOS application was filed with EB3 I-140. Does the EB2 I-140 adversely affect the AC21 after I join the new employer. What will happen to my pending AOS application, when USCIS processes the EB2 I-140 from my original employer, before or after I have used AC21 from the new employer.

    Appreciate your feedbacks on this.
